General Terms of Service

1. Introduction

These general terms of service (“Terms“) apply to the use of Foytech AB's (“Foytech”) AI platform (“Platform”). By using the Platform, the user (“User”) accepts these Terms.

2. Usage

2.1 Foytech grants the User a limited, non-exclusive, non-transferable right to use the Platform in accordance with these Terms.

2.2 The User may not copy, modify, distribute, sell or rent out any part of the Platform.

3. Liability

3.1 The Platform is provided “as is“ without any warranties, express or implied.

3.2 The Platform and the responses generated by the Platform are based on publicly available legal data. FoyTech takes no responsibility for the accuracy, completeness and/or up-to-dateness of the legal data.

3.3 FoyTech also has no responsibility for information that the User adds to the Platform.

3.4 The use of the Platform and the responses generated by the Platform do not constitute advice and cannot be equated with this. FoyTech thus takes no responsibility for any financial consequences resulting from the given answers and the User's use of them, including the User's possible advice to third parties.

3.5 Under no circumstances can FoyTech be held liable to the User for indirect losses or consequential damages including but not limited to business losses, loss of expected profit, loss and/or recovery of data, loss of goodwill or other types of consequential damages. FoyTech's total liability under these Terms and the User's use of the Platform is limited to one (1) price base amount.

3.6 In the event of a User's breach of the Terms, the User shall, in addition to any claims for compensation for unauthorized use of the Platform, compensate FoyTech for all damages incurred by FoyTech as a result of such breach of contract.

4. Intellectual Property Rights

4.1 Foytech, or the third party from which Foytech derives its rights, retains ownership of all its rights (including intellectual property rights) related to the Platform, and the User's access to the Platform does not imply any grant of license or other right beyond what is stated in section 2.1.

4.2 The User shall respect Foytech's, and where applicable third party's, rights, and the User is, without limitation of amount, responsible for violations of these rights, including unauthorized forwarding of the Platform or related rights to third parties.

4.3 Reproduction, distribution and other making available or disposal of the Platform is not permitted without Foytech's consent.

5. Confidentiality and Data Protection

5.1 Foytech will process the User's personal data in accordance with Foytech's privacy policy.

5.2 The User is responsible for ensuring that the User has the right to share any information the User uploads to the Platform.

6. Shutdown and Termination

FoyTech may at any time and without giving reasons shut down the Platform as a whole and/or terminate or shut down the User's access to the Platform. Upon such shutdown and/or termination, the User's right to use the Platform ceases immediately.

7. Changes to the Terms

Foytech has the right to change these Terms at any time. Continued use of the Platform after such changes constitutes the User's acceptance of the new Terms.

8. Applicable Law and Disputes

These Terms shall be governed by and construed in accordance with Swedish law. Any disputes shall be settled by a general court.
